Terms of Service

1. Acceptance of Terms

By accessing or using 24/7 OnCall ("the Service"), operated by Kevin Vo ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

24/7 OnCall provides an AI-powered virtual receptionist that answers phone calls on behalf of your business. The Service includes: AI phone answering with a custom greeting; SMS text summaries of each call sent to the business owner; caller information capture and lead notifications; and an onboarding process to customize the AI for your business.

3. Account and Subscription

To use the Service, you must subscribe through our website. The current subscription price is $99 per month, which includes up to 1,000 minutes of AI call handling per billing cycle. If your usage exceeds 1,000 minutes in a billing cycle, incoming calls will be routed to your voicemail for the remainder of that cycle. You may cancel your subscription at any time — there are no long-term contracts. Upon cancellation, your service will remain active through the end of the current billing period. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Text Messaging Terms

By using the Service, you consent to receive text messages from 24/7 OnCall, including:

Program name: 24/7 OnCall Notifications
Message types: Call summaries, lead notifications, service updates, and demo follow-ups.
Message frequency: Varies based on call volume. Business owners may receive multiple messages per day depending on incoming calls. Demo callers receive a single follow-up message.
Message and data rates: Standard message and data rates may apply depending on your carrier and plan.
Opt-out: Reply STOP to any message to stop receiving texts. You will receive a confirmation message.
Help: Reply HELP for support, or contact support@24-7oncall.ai.
Supported carriers: Major US carriers including AT&T, T-Mobile, Verizon, and others.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; provide false information during sign-up or onboarding; attempt to reverse engineer or interfere with the Service; use the Service to make automated or robocalls; or resell the Service without our written consent.

6. AI Limitations

Our AI receptionist is designed to handle common business calls but is not a replacement for human judgment. The AI may occasionally misinterpret callers, miss nuances, or produce inaccurate summaries. We are not liable for any business losses resulting from AI errors or limitations. You are responsible for reviewing call summaries and following up with callers as needed.

7. Payment and Billing

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Failed payments may result in service suspension. Refunds are handled on a case-by-case basis — contact us if you have billing concerns.

8. Service Availability

We strive to maintain 24/7 availability but do not guarantee uninterrupted service. Occasional downtime may occur for maintenance, updates, or due to third-party service disruptions (telephony providers, cloud hosting, etc.). We will make reasonable efforts to notify you of planned maintenance.

9. Intellectual Property

All content, branding, and technology associated with 24/7 OnCall are owned by us. You retain ownership of your business information and data provided to us during onboarding and use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, 24/7 OnCall shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost revenue, missed calls, or business interruption. Our total liability shall not exceed the amount you paid for the Service in the preceding 3 months.

11. Termination

We may suspend or terminate your account if you violate these Terms or engage in abusive behavior. You may cancel your subscription at any time through your account or by contacting us.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.
